Does ICANN have Authority?

A small New York Company, Name.Space,  says that ICANN does not have control over 482 top-level domain strings and the company claims that cannot be awarded to others. It claims that the company has been operating a root DNS system that has been functional since 1996. The CEO of Name.Space has notified ICANN that they cannot use these domain names and that these names predate ICANN and they do not have authority to sell them to third parties.
