.HN Domain Dispute Policy Honduras FAQ - What is 101Domain's dispute policy concerning trademarks and registration of domain names under .HN?
- All domain name registrations are subject to our registration agreement and dispute resolution policy. ICANN has adopted a universal Dispute Policy Resolution Policy that clearly states that all disputes will be handled legally with respect to the rules and regulations of the .HN extension. In the event that the Domain Name is registered, you agree to be bound by the Dispute Policy that is incorporated herein by reference and made a part hereof. - What should I do if there is a domain name dispute or domain name conflict?
- All natural or legal person assumes the right to object or to revoke any request for the registry of a domain name when they consider their rights affected. The request will be presented before the Center of Inscription and Registry of Domain Names, 101Domain will notify the Administrative Contact, to effect of which the parts can dissolve the controversy in the terms and procedures that they consider best.
a. To request the revocation of a domain, the petitioner must present in written form the arguments sustaining his/her solicitation.
b. Pays the tariff corresponding to the study and investigation of the file to send it to arbitrate or Court designated by the parts in order to dissolve the conflict.
c. If from the analysis and conducted investigation request proves to be admissible, the administrative contact will be notified via email with copy to the parties involved in the conflict, so that they determine a possible resolution.
d. Reasons for the revocation of a domain name:
* That their inscription is abusive, or that it has been made of bad faith
* Membership expiration
* To reserve with commercialization purposes
* Failure to fulfill the general policies
The registry of a domain name is considered abusive when:
* That the dominion name is identical or similar to a product brand or service over which the subscriber has authentic right, or to a name by which the reclaiming party is known.
* That the subscriber of the domain name does not have any rights or legitimate interests with respect to the domain name.
* That the domain name has been registered and is used in bad faith.
The concurrence of any of the following circumstances, even without their enunciation being direct, will serve as proof to demonstrate the bad faith of the legatee of the objected domain:
* Those circumstances indicate that the domain has been registered with the intention to sell it, rent it or commercialize it of any other form.
* That the domain has been registered under a name intended to affect the competition.
* That with the domain name, the subscriber intends to attract internet users for profit, causing confusion and affecting a third party or existing brand.
We will proceed according to the objection made, by eliminating the domain as soon as we receive a letter notifying the decision of the party or the emitted decision made by a competent tribunal, in which by arbitration will be the proceed to put an end to this conflict.
After a period of a 30 working day calendar since the publication of the domain and there are no objections by a third party. The domain registered will be considered permanent, whenever the subscriber fulfills all the requirements established by the present policy to conserve membership rights.
