  • When can FICORA suspend a .fi domain name?
  • According to the Act on Domain Names, FICORA can suspend a .fi domain name for no longer than 1 year, if:
    * the police or a prosecuting authority has requested suspension on the grounds of probable cause to suspect that the domain name is being used for criminal purposes;- there are no functional name servers for the domain name, or its other network-technical definitions continuously or substantially breach the FICORA regulations referred to in the second clause of section five, and the fault has not been corrected regardless of a request by FICORA to do so;- there is probable cause to suspect that the domain name has been transferred to someone else without the consent of the holder of the domain name or a protected name or trademark, the holder requests the suspension of the domain name and the recipient of the transfer does not provide acceptable grounds for his or her right to the domain name within a two-week time limit;- there is probable cause to suspect that the domain name is a protected name or trademark, the holder of the name or trademark requests the suspension of the domain name and the holder of the domain name does not provide acceptable grounds for his or her right to the domain name within a two-week time limit;- there is probable cause to suspect that the domain name is a derivative of a protected name or a trademark or a derivative of the name of a natural person and has been acquired with the evident purpose of benefiting from it or causing harm, and the holder of the name or trademark requests the suspension of the domain name, and the holder of the domain name does not provide acceptable grounds for his or her right to the domain name within a two-week time limit;- there is probable cause to suspect that a domain name based on the name of a natural person is in the possession of a natural person with a different name, and the holder of the domain name does not provide acceptable grounds for his or her right to the domain name within a two-week time limit; or- there is probable cause to suspect that a domain name based on the name of a natural person is in the possession of a legal person who is not the holder of the rights to the protected name or trademark matching the persons name, and the holder of the domain name does not provide acceptable grounds for its right to the domain name within a two-week time limit.
    In such a case, the holder retains the right to a suspended domain name but is unable to use it.
  • When can FICORA revoke a .fi domain name?
  • According to the Act on Domain Names, FICORA can revoke a .fi domain name, if:
    * the applicant has specified fundamentally insufficient or incorrect information in the application to FICORA, or failed to report essential information, and the holder of the domain name does not correct and complement the information regardless of a request to do so;- there is a cogent reason to suspect that the domain name has been transferred to someone else without the consent of the holder of the domain name or a protected name or trademark, the holder requests the revocation of the domain name, and the recipient of the transfer does not provide acceptable grounds for his or her right to the domain name within a two-week time limit;- there is a cogent reason to suspect that the domain name is a protected name or trademark, the holder of the name or trademark requests the revocation of the domain name and the holder of the domain name does not provide acceptable grounds for his or her right to the domain name within a two-week time limit;- there is a cogent reason to suspect that a domain name based on the name of a natural person is in the possession of a natural person with a different name or a legal person who is not the holder of the rights to the protected name or trademark matching the persons name, and the holder of the domain name does not provide acceptable grounds for its right to the domain name within a two-week time limit.- there is a cogent reason to suspect that the domain name is a derivative of a protected name or a trademark or a derivative of the name of a natural person and has been acquired with the evident purpose of benefit or harm, the holder of the name or trademark requests the revocation of the domain name, and the holder of the domain name does not provide acceptable grounds for his or her right to the domain name within a two-week time limit;- a court of law has forbidden the use of the domain name by a final judgement;- the holder of the domain name no longer exists;- the domain name has been suspended based on the second paragraph of the first clause of section eleven for at least a month, and the flaw was not subsequently corrected within one month of a request being sent by FICORA to do so;- it becomes evident after the granting of the domain name that it contains offensive terms or incitements to commit an offence, or it has been formed in breach of the regulations in the third clause of section four; or- the obvious intent of the applicant was to reserve the domain name for resale.
    The revoked domain name will become available for re-application after three months. Should a violation of a name or trademark occur, however, the domain name can be transferred to the rightful holder, who demanded the name to be revoked, immediately following revocation.
